thesupportavailabletoyou,andyouraccesstojusticemayvaryaccordingtowhereyoureportthecrime.Inmanycountries,youneedtoreportthecrimebeforeyouleavethecountry,ifyouwantittobeinvestigatedandpolicetoobtainimportantevidence.ifyouarestayinginthecountrywherethecrimetookplace,youshouldreportthecrimeinthatcountry.IfyouareaBritishnationalandyouneedhelptoreportthecrime,youcancontactthenearestBritishembassy,highcommissionorconsulate,ortheForeign,Commonwealth&DevelopmentOfficeinLondon.ifyoudonotreportthecrimeinthecountrywhereithappenedandyoureturntotheUK,youcanstillreportthemattertoyourlocalUKpolice.theUKpoliceshouldsendtheinformationyouprovidetothecountrywherethecrimehappened.However,itisforforeignpoliceforcestodecidewhethertoinvestigateacrimeintheirjurisdictionandtheymaynottakeaction.youcanreportthecrimetotheUKpoliceevenifyouarenotseekinganinvestigationabroad.TheUKpolicecanofferyouaccesstovictimsupportintheUK.Theymaystillsendsomedetailsofthecrimetopoliceinthecountrywhereithappened.Thismightbenecessaryinordertoprotectvulnerablepeople,ortostopmorecrimesbeingcommitted.
Reporting the crime in Antigua - what happens next?
ifyouchoosetoreportthecrime,trytodosoassoonaspossible,soforensicevidencecanberetained.washingyourselforyourclothesmaymakeitdifficultforthepolicetoobtainforensicevidence.ifyouchangeyourclothes,thinkabouttakingthoseyouwerewearingtothepolice.Youmaywishtopreserveevidencebyretainingitemssuchascondoms,toothbrushes,ortextsandsocialmediamessages.tellthepoliceifyouthinkyouhavebeendrugged.insistyougetapolicereport,andrequestatranslationinEnglishifapplicable.youwillbeexpectedtomakeastatementabouttheincidentincludingadescriptionoftheattacker(s).thepolicewillkeepanyclothingandphysicalevidencewhichmaybeevidenceofyourattacktopresenttoaforensicexaminer.youwillbetakenthedistrictdoctorresponsibleforthedistrictinwhichtheoffensehappenedortoGenderAffairsforexaminationandcounselling.thelocalpolicewouldinformtheBritishHighCommissionoftheassault.thelocalpolicewouldnotrequestapolicecheckonthevictimasacommonpractice.
The medical examination – what to expect
CIDofficersarecontactedandtheexaminationisdoneatthehealthcenterintheareawheretheoffensetookplace;however,thedoctormayasktousethegeneralhospitalfacilities.ifthevictimgoestothethepublichospitaltheywillautomaticallyreporttheresultstothepolice,particularlywhenthecrimehasalreadybeenreported.Ifthecrimehasyettobereportedthehospitalmaycallthepoliceonthevictimsbehalf.thedistrictmedicalofficerintheareainwhichtheincidentoccurswillcarryouttheexamination.Aphysicalexaminationwillbeconducted,labandbloodsamplestaken,andarapekit(steps1–14),alongwithanyothernecessaryexaminationasdeterminedbythemedicalpracticioner.Photographsaregenerallytakenoftheinjuries.oncethecrimeisreportedtothepolice,localtouroperators/policewillaccompanyyoutothehospital.

We can also contact friends and family on your behalf and any organizations that may be able to provide assistance.
Treatment
hospitalmedicalstaffandtheInfectioncontroldepartmentcangiveadviceonHIVPEPmedication(‘Post-exposureprophylaxis’,atreatmentthatcanpreventHIVinfection).PEPisavailablelocallythroughtheClinicalcarecoordinatorassignedtoyourcase.Itisbothmedicallyprescribedandcloselymonitored.HIVPEPmedicationneedstobetakenwithin72hoursoftheincidentforittobeeffective.TheNHSmaybeabletocommenceorcontinuethe28daytreatmentonreturntotheUK.youcanaccessemergencycontraceptionthroughtheA&BFamilyPlanningAssociationwithasmallfeeattached.Aprescriptionisnotrequiredforaccessemergencycontraceptionneedstobetakenwithin72hoursoftheincidentforittobeeffective.hospitaltreatmentandtestsarepaidforbytheindividualorthroughinsurance.ifyouhavehadmedicationadministeredoverseas,youmaywishtokeepthelabelormakeanoteofthenameofthemedication,sothatyouletyourlocalhealthproviderknowwhenyoureturnhome.
Police investigations in Antigua – what to expect
thePolicewillnottakethevictimtothesceneofthecrime,unlessorderedbythejudgepresidingoverthecaseinuniquecircumstances.
*if a suspect is brought to the police station the victim will be asked to identify the suspect generally through an ID Parade.Your identity will be protected.
itisthemandateofthepolicetocompletetheinvestigationwithin3to4months,atwhichtimethecasewouldthenappearbeforethepublicprosecutor.Afterthis,thecasewillenterthecommittalstageattheMagistrateCourtforassizes.thevictimwillbeexpectedtogobeforethepublicprosecutortomakeastatementoncethematterisbeingheard.Thelawyerscannotdothis.Thelawyershaveaccesstothevictim/casenotesatthisstage(however,allrequestsfornotesaremadethroughtheCommissionerofPolice).victim(s)willbeallowedtoleavethecountryoncethecaseisfiled.
Court procedures – what to expect
thevictimwillbeexpectedtotestifyincourtduringthetrial.Currentlythevictimisexpectedtoreturntothecountrytogivetestimonythevictimisentitledtobekeptawareofthecase.ThiscanbedonethroughtheBritishHighCommissionorlocalpolice.Hiringalawyercanprotectyourlegalinterestwithinthejusticesystembutitisnotarequirement.oncethestatementhasbeengiventhereisgenerallynoneedtogiveanadditionalstatement.thevictimmaydropchargesoncefiledwithoutthefearofanylegalrepercussions.Furthermore,therearenolegalconsequencesfordroppingcharges.Thechargeofrapeisnotanautomaticstateprosecutedcharge,theprosecutioncandropthechargesdependingontheevidencepresented.theassailantcannotpresscountercharges.thecourtscannotordertheoffendertopaycompensationinthecriminalcourt,however,acivilcasecanbebroughtbeforethecourtsonceithasbeenheardandconvictedinthecriminalcourts.thereisnostatefundedschemeforthiscasetypetocovercompensationforphysicalorpsychologicalinjuriessufferedasaresultofviolentcrime.
How can my case be taken to trial?
thereisnoneedforthevictimtofileanythingortomakefilingsastheirwitnessstatementtothepoliceissufficient.
Trial procedures
thereisnosettimetodeterminewhenatrialwillbestarted,howeverthevictimisgenerallyinformedonceadatehasbeenset.ThetrialwillbeconductedinEnglishthevictimdoesn’tneedtobepresentateverycourtsessionsbutcouldpotentiallybecalledforthecommittalhearing.Thetrialhowevermaybetheonlyrequiredstagewherethevictim’spresenceisnecessary.Currentlythevictimisrequiredtoreturntothecountrytogivetestimony.thecountryconcernedmayassistwithtravelandaccommodationarrangements,however,noothersupportwillbeprovided.itcantakeapproximatelytwo(2)tothree(3)yearsforacasetocometotrial.Thetrialslengthisdependentonmultiplefactorswhichmainlyinvolvethedefendant.Ifthereisapointoflaworanoccurrenceduringthetrialthedefendantmayhavetherighttoappeal.Therearetwoappellantlevelstowhichthedefendantcouldbeheard.
Communication
theDirectorofPublicProsecutionsofficewouldcommunicatewiththevictimatdifferentstagesoftheproceedingse.g.toinformoftrialdateandtoarrangefortestimony.ifthevictimisnotresidentin-countrythentheDirectorofPublicProsecution’sofficewillstillmaintaincontacthowever,theConsularsectionattheBritishHighCommissioncouldfollowuponbehalfofthevictimtoprovideupdates.
Legal Aid
legalaidisnotavailableforvictimsasalawyerisnotrequired.
Sentencing
sentencesforthiscasetypeareweightedinfavourofpunishment.theperpetratorinthiscasetypewouldbeguiltyof’crimeagainsttheperson’.judgesareabletopassdownsentencesofimprisonment.iftheallegedperpetratorisfoundnotguilty,theyarereleased.
Compensation
thecourtscannotordertheoffendertopaycompensationinthecriminalcourt,however,civilcourthastheabilitytodosooncethecasehasbeentriedinthecriminalcourt.thereisnostate-fundedcompensationschemeforpersonswhohavesufferedinjuryasaresultofasexual assaultorabroadviolentcrime.
