The Charity Commission has the power to appoint an Interim Manager (‘IM’) to act as receiver and manager in respect of the property and affairs of a charity. An IM has the same duties and responsibilities as a trustee in relation to the management and administration of a charity . The Commission can only use this protective power after opening a statutory inquiry under section 46 of the Charities Act 2011 (‘the Act’), if it is satisfied either that there is or has been misconduct and/or mismanagement in the administration of a charity or that it is necessary or desirable to protect the charity’s property.

  1. Amended the code of practice to update data protection requirements for appointed Interim Managers. Expanded the Application checklist: areas of expertise to include housing, faith based organisations, crypto currency and cyber security.

  2. Updated to include greater transparency on the framework the Commission will apply when considering removing practitioners from the approved IM list and a new requirement to provide a named point of contact at the firm.

  3. Updated to clarify the application process for practitioners to join the approved list, making it clearer the information that we require from applicant practitioners and their firms.

  4. List of approved practitioners added to the guidance.

  5. Updated code of practice.

  6. The dates for applications to join the Commission’s list of approved practitioners have changed. You can apply between 1 May and 31 May.

  7. Added a list of approved Interim Managers.

  8. In section 2 we have added information about the types of applications sought.
